Variances and Special Processes
A variance is a written document from the regulatory authority that allows an operation to modify or waive a specific food code requirement. This hub covers what a variance is, the special processes that require one, the HACCP plan that must accompany the request, and how the topic is tested.
Most food safety rules apply the same way to every operation. A few processes fall outside what a general rule can safely cover, and for those the regulator grants permission case by case. That permission is a variance.
What is a variance in food safety?
A variance is a written document issued by the regulatory authority that allows an operation to modify or waive a specific requirement of the food code. It is granted in advance, in writing, for one named process at one named operation, and it comes with conditions the operation must follow exactly.
Three parts of that definition carry the exam weight.
It is written. A conversation with an inspector is not a variance. Neither is a note in a file or a verbal assurance from a health department clerk. If a scenario describes a manager who "checked with the health department and they said it was fine," the operation does not have a variance.
It comes from the regulatory authority. Usually the local health department. Not from a supplier, a consultant, a corporate office, a trade association, or a certification body.
It is obtained before the process starts. A variance cannot be applied for retroactively to cover a process already running. Approval comes first.
A variance does not lower the standard of safety. It substitutes a different, documented control for the one the code assumes, and the operation has to prove that substitute works.
Which processes require a variance?
A variance is required when an operation intends to do something the code either prohibits outright or permits only under additional controls.

The 9th Edition adds an explicit caution here, and it is worth carrying into the exam: there may be other situations in which a variance is required, beyond food preparation methods. Do not treat the list as complete. Treat "check with the regulatory authority" as the correct instinct in any unfamiliar case, because it is very often the correct answer to a scenario question too.
How an operation obtains a variance
- Submit a written request to the local regulatory authority describing the proposed process.
- Provide a HACCP plan showing how the hazards of that process will be controlled: the hazard analysis, the critical control points, the critical limits, the monitoring procedures, the corrective actions, verification, and record keeping.
- Include supporting documentation of the science behind the method, such as validation studies, a process authority letter, or published research showing the process delivers the necessary pathogen reduction.
- Wait for written approval before starting.
The regulatory authority reviews the package, may require changes, and issues the variance in writing if it approves. After that the operation must follow the conditions of the variance precisely and keep every record the plan requires. Records are how the operation proves compliance at the next inspection, and a variance operated without its records is effectively no variance at all.
A variance always requires a HACCP plan. That link is one of the most reliable single facts on this topic. If an exam answer option describes a special process approved without any documented hazard control, it is wrong.
Variance, HACCP plan, and permit: three different documents
Candidates lose points by mixing these up.

A permit lets you open. A HACCP plan is how you control a hazard. A variance is permission to do something the code would otherwise prohibit, and the HACCP plan is the evidence that supports the request.
What happens without one
Running a special process without an approved variance is a violation on its own, independent of whether anyone gets sick. An inspector who finds a kitchen curing charcuterie, vacuum sealing sous vide bags for later service, or sprouting mung beans without a variance can order the process stopped, order the product discarded, and cite the operation. In serious cases the permit itself is at risk.
The risk is not theoretical either. Reduced-oxygen packaging is on the list because Clostridium botulinum grows without oxygen and produces the most lethal foodborne toxin known. Sprouting is on the list because outbreak after outbreak has traced back to it. These are not paperwork categories. They are the processes that have historically hurt people.
Food Handler versus Manager: how deep to go
Food Handler candidates are rarely tested on variances in any depth. What is useful is the general shape: some processes need special written permission from the health department, and a food handler who is asked to start one should check with the manager rather than proceed.
Manager candidates need the definition close to word-perfect, the list of processes that require a variance, the fact that it always requires a HACCP plan and supporting documentation, the sequence of applying and waiting for written approval, the distinction between a variance, a HACCP plan, and a permit, and the 9th Edition caution that the list of triggering situations is not exhaustive.
